A.R.S. § 23-103 – Establishing A Quorum For Operation Of The Arizona Industrial Commission

Arizona Revised Statute Section 23-103 addresses the number of commissioners who are required in order for the Arizona Industrial Commission to transact business. The statutes states:

A majority of the commission shall constitute a quorum to transact business. When a vacancy occurs in the commission, the remaining commissioners may exercise all the powers of the commission until the vacancy is filled.

Although it seems straightforward that a simple majority of the existing commissioners is required, disputes have arisen about whether certain decisions of the commission have been valid. Any legal questions related to the interpretation or operation of an Arizona statute should be discussed with an Arizona attorney.
